By using any services offered by SMS ONLY, including but not limited to Bulk SMS, WhatsApp API, and Digital Marketing services, you agree to comply with these Terms and all applicable laws and regulations.

2. Service Usage & Restrictions

Permitted Use

Our services are intended exclusively for legal and ethical business communication.

Prohibited Use

• Sending unsolicited messages (Spam)
• Phishing, fraud, or impersonation
• Offensive, abusive, or illegal content
• Violation of any local, national, or international laws

Your Responsibilities

You are solely responsible for all content and campaigns launched using our platform. You must comply with applicable regulations including:

• TRAI (Telecom Regulatory Authority of India)
• GDPR (General Data Protection Regulation)
• Information Technology Act, 2000 (India)

Violations may result in immediate suspension or termination of services.

3. Payments, Billing & Refunds

• All services are provided on a prepaid basis
• Payments are non-refundable except in cases of service failure directly attributable to SMS ONLY
• We reserve the right to modify pricing with prior notice
• Services may be suspended for non-payment or policy violations

4. Limitation of Liability

SMS ONLY shall not be liable for message delivery failures caused by telecom operators, DND filters, incorrect recipient data, or external network issues.

We do not guarantee 100% delivery rates as delivery depends on external systems and compliance factors.

5. Data Compliance & Legal Obligations

• DLT registration, sender ID & template approval as per TRAI
• Obtaining proper user consent under GDPR & IT Act 2000
• Avoiding unlawful or non-compliant campaigns

Non-compliance may result in account suspension, legal action, or reporting to authorities.

6. Intellectual Property

All software, tools, and content provided by SMS ONLY remain its exclusive intellectual property. Unauthorized copying, resale, or distribution is strictly prohibited.

7. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts located in Chennai.
